How We Helped a Falsely Accused Doctor Clear His Name in New Jersey

A Doctor Doing His Job

Our client primarily focused on treating elderly patients in his practice. He had been practicing for years and had built a reputation for his excellent care and expertise. However, around 15% of his practice was pain management, which is when the trouble began. One morning, without warning, his practice was raided by law enforcement, and they seized all of his documents and medical records. Before he knew it, he was required to temporarily forfeit his license to practice medicine and was charged with illegally prescribing medication.

What We Did To Clear Our Falsely Accused Client’s Name

Our client informed us that he did in fact prescribe those medications to the undercover officers, but for medically valid reasons.

Interestingly, the two undercover officers who claimed to have been prescribed illegal medication were actually terminated by our client for not acting in accordance with the issues they claimed to be suffering from. With this information, we were well-equipped to continue our investigation and uncover the truth of the matter.

The Findings

We uncovered some startling information that shed light on our client’s legal case. It turns out that one of our client’s employees had been stealing his prescription medication and selling it without his knowledge. Our client was completely unaware of this illegal activity, which came to light when he was arrested and charged with distribution. However, there was no evidence to suggest that our client was complicit in the sale of the stolen prescriptions. 

To further corroborate this, we enlisted the opinion of an independent medical expert who evaluated the case and deemed the prescriptions to be valid and in line with accepted medical practices. This provided us with a solid foundation to build our client’s defense on, and helped to ensure that justice was served.

In light of the circumstances, the case against our client was ultimately dismissed before any indictment could be made. That’s certainly good news for him, as he’s since regained his medical license and is now able to practice medicine once again. However, it’s important to acknowledge that being charged with a crime, even if it doesn’t result in a conviction, can have lasting consequences. Regardless of whether someone is truly guilty or not, unfairly or not, there will be a lingering stigma associated with the charge. This is simply the unfortunate reality of our criminal justice system.
