How We Helped a Client Get His Life Back on Track After Being Charged with Felony and DUI

Our client had woken up one day thinking that he was using cocaine, but it turned out that he had been ingesting heroin unknowingly. Less than an hour later, he was involved in a motor vehicle accident while driving under the influence. He was then charged with a felony and DUI and faced the possibility of spending three to five years in state prison. 

First Steps After A DUI

As soon as our client came to us, we advised him to invoke his right to remain silent and not provide any information to the law enforcement without our final advice. We then contacted the prosecutor’s office and requested them to downgrade the charges against our client. Unfortunately, the prosecutor was not willing to downgrade the charges and instead asked our client to plea guilty to a felony charge, three years of monitoring, and a DUI.

We rejected that offer and started litigating the case at the Municipal Court level. Through our analysis of the discovery, we found that the blood draw conducted on our client was in violation of state law, and the blood results could not be considered. We presented our findings to the court, and as a result, all of the charges against our client were dismissed, and the DUI charge was reduced to reckless driving.
